The right to privacy is the right of a person to keep his or her person and property free from public scrutiny. To protect this right for patients and families, only those responsible for their care should conduct an examination or discuss their case. The right to privacy is protected by state constitutions, statutes, and common law. The Health Insurance Portability and Accountability Act of 1996 (HIPAA), also has a provision to guarantee the security and privacy of health information.
